Additional Terms for App Stores

This Appendix A supplements Section 2.6 (Additional Terms for App Stores) and forms part of the Terms. In case of conflict, this Appendix prevails with respect to the use of the App in stores.

A.1 Relationship with Apple and Google.

This EULA/Agreement is entered into exclusively between the User and MIO3, S.A. de C.V. ("MIO3"), not with Apple Inc. ("Apple") or Google LLC ("Google"). Apple and Google are not responsible for the App or its content.

A.2 Scope of the license in stores.

MIO3 grants the User a personal, limited, non-exclusive, non-transferable and revocable license to:

iOS (Apple): Use the App on Apple devices owned or controlled by the User and in accordance with the Apple Media Services Terms and Conditions. Android (Google Play): Use the App on the User's Android devices in accordance with Google Play policies. Any use that violates these rules/policies or these Terms is prohibited.

A.3 Support and maintenance.

MIO3 is solely responsible for the support, service, and maintenance of the App. Apple and Google have no obligation to provide maintenance or support services for the App.

A.4 Guarantees and claims.

To the fullest extent permitted by law, the App is provided "as is" and "as available." Apple and Google make no warranties regarding the App. Any product, security, legal compliance, or intellectual property claims relating to the App should be directed exclusively to MIO3 (see Section 35 – Contact and Notifications).

On iOS: If the App does not conform to any applicable warranty and a purchase price has been charged by Apple, the User may notify Apple and Apple, where appropriate, will refund the purchase price; to the extent of law, Apple will have no other warranty obligations with respect to the App.

A.5 In-App purchases, subscriptions and refunds.

Where applicable and if required by the store, purchases of digital goods/services consumed within the App will be processed through the store's billing system (e.g., Apple In-App Purchases or Google Play Billing); refunds are governed by the store's policies. In all other cases, payments are made outside the store in accordance with the Terms (see 4.13 and 4.14). Automatic renewals, cancellations, and trial periods for store-managed subscriptions are administered through the User's store account.

A.6 Legal compliance, export and sanctions.

The User represents and warrants that: (i) they are not located in a country subject to embargo/sanctions or prohibited lists (e.g., export control lists); (ii) they will use the App in compliance with applicable laws, including export controls and sanctions regimes; and (iii) they will not use the App for purposes prohibited by such laws.

A.7 Third-party beneficiary (Apple).

The User acknowledges that Apple and its subsidiaries are third-party beneficiaries of this EULA only and that, by accepting the EULA, Apple will have the right (and will be deemed to have accepted the right) to demand its enforcement against the User as it concerns him.

A.8 Google Play requirements and policies.

The User and the App will be governed by the Google Play Developer Program Policies, including the User Data Policy (Data Safety), Financial Services, Ads, and, where applicable, Families. Without limiting the foregoing:

The App does not allow cryptocurrency mining on the device;

any financial or digital asset functionality complies with applicable local laws and Google Play policies; The App does not promise guaranteed returns or make misleading or unrealistic claims. ## A.9 Termination. MIO3 may terminate the license if the User violates this EULA, the Terms, or the store policies. The store may also suspend or remove the App in accordance with its rules. Upon termination, the User must cease use and uninstall the App. Sections that, by their nature, must remain, will remain.
